California Motorcycle Warranty Attorneys

What are some common motorcycle warranty problems in California and what can you do to protect yourself against frustrations that often flummox disgruntled bike owners?

  1. Not having a written warranty:

It's perfectly legal to purchase a motorcycle or other motor vehicle without a contract. But if down the line you and the seller have a disagreement (over, for instance, responsibility for maintenance payments), and the matter goes to court, you'll be left with a simple "he said, she said" argument. In other words, if the seller proves that his/her word trumps yours, you lose the case. If, on the other hand, you have a legitimate purchase contract and warranty, you have a lot more legal bargaining power.

  2. Failure to transfer or obtain the original manufacturer's warranty:

Just because you buy a bike with a warranty doesn't mean the warranty automatically transfers to you. To obtain the warranty and avoid future motorcycle warranty problems, you might have to pay the seller or manufacturer. Furthermore, some warranties spell out limitations imposed on secondhand buyers. If you buy from a private seller, there may be no implied warranty under CA State Law. Thus, if you want guarantees of performance, you must include such stipulations in your purchase contract.

  3. Failure to inspect a bike before buying it:

True, a motorcycle seller has legal obligations to you. He or she must provide a Smog Certificate stating that the bike does or does not comply with CA Emissions Regulations, for example.

Nevertheless, to be on the safe side, it's wise to have an independent inspector appraise the bike for problems with valves, hoses, headlights, circuitry, and the like. The best way to avoid warranty problems is to buy a good bike in the first place!

  4. Trouble getting seller/manufacturer to comply with warranty responsibilities:

Just because you're entitled to remedies according to your bike's warranty doesn't mean that the responsible party will gladly provide you with money or parts. In some cases, you must legally wrangle to get compensated fairly. To move forward in this regard, connect with the law offices of Howard D. Silver at 1-866-495-3666.
